Positron Pay, as a provider of payment services including gift cards, credit purchase, payments to stores, etc., is subject to all laws and regulations of the Islamic Republic of Iran; The following agreement has been prepared regarding the proper and safe use of the Positron Pay website and preventing any possible abuse. This agreement, which determines the obligations and duties of the parties, is concluded between Pouyan Trust Management and Development Company, registration number 617340, as the first party and the user of the Positron Pay website as the second party; Pouyan Trust Management and Development Company is the owner of the Positron Pay website, which from now on in the text will be called 'Positron Pay' and the user of the Positron Pay website 'User'. Acceptance of these terms of use means acceptance and electronic signing of the contract.

All material and moral rights of the Positron Pay mobile payment network and its trademark belong to Pouyan Trust Management and Development Company (Private Joint Stock) with registration number 617340.

Any use of the name, claims, documents and resources of Positron Pay without the written permission of the company, in accordance with the computer crimes laws (Computer Crimes Law 11/11/1389 - Working Group to Determine Criminal Content Examples) is considered unauthorized and Positron Pay reserves the right to legal prosecution in competent authorities. The license to use Positron Pay according to the current terms of use is only for the use of one real customer and in his name.

Any copying and attempt to access Positron Pay data, according to the laws governing the Islamic Republic of Iran, is considered unauthorized and will result in legal prosecution. The user does not have the right to use registered and unregistered trademarks and signs displayed in Positron Pay. This prohibition applies to all technical and non-technical components of the Positron Pay payment network; It should be noted that violation of this prohibition cannot be justified with titles such as issuing permission or implied and implicit right, or lack of denial after acceptance, etc.

Any use of Positron Pay application services that according to the country's laws, including the Electronic Commerce Law, Computer Crimes Law and Islamic Penal Law, is considered a criminal act or behavior, is prohibited.

1. Payment through or use of the Positron Pay website is prohibited for the following cases:
   • Purchase and sale of real estate.
   • Purchase and sale of lottery cards, and participation in any gambling and betting.
   • Use of virtual private network (VPN) and purchase and sale of software to bypass the filtering of the Islamic Republic of Iran.
   • Use of services for any hacking, intrusion and unauthorized access.
   • Purchase and sale of goods that do not respect the rights of the publisher, owner, author, creator of the work and the like (violation of copyright laws).
   • Purchase and sale of cigarettes and other tobacco products.
   • Purchase and sale of firearms and cold weapons.
   • Purchase and sale of goods and services whose exchange has specific regulations and systems.
   • Purchase and sale of goods that pose a serious risk to consumers.
   • Purchase and sale of goods whose exchange is prohibited by law, including drugs, alcoholic beverages, psychotropic substances, intoxicating substances, contraband goods.
   • Purchase and sale of goods whose exchange is contrary to Islamic customs.
   • Purchase and sale of goods and services that encourage or facilitate illegal activities in any way.
   • Purchase and sale of goods obtained from crime or violation of country and military regulations.
   • Purchase and sale of all goods or services whose provision requires obtaining a license or permit.
2. Any action that, in the opinion of Positron Pay, leads to the issuance of an order to deal with the customer by judicial, disciplinary or security authorities regarding violations in the field of electronic payment, will result in the suspension of services to the user.
3. Engaging in acts related to financial abuse and money laundering or creating disruption in the country's monetary and banking sector, in the opinion of Positron Pay, will result in the suspension of services to the user.
4. Activities leading to disruption in the liquidity flow, in the opinion of Positron Pay, will result in the suspension of services to the user.
5. The user authorizes Positron Pay to respond to any inquiry from any official authority of the country regarding the user's information; The user will not have the right to object to the disclosure of their information to official authorities.
6. It is desirable to use Positron Pay services only by visiting the Positron Pay website.
7. The user is responsible for maintaining and protecting their password and user code, and if damage is caused to them due to lack of protection or disclosure of this information by the user, Positron Pay will not be responsible in this regard.
8. The Positron Pay user is obliged to immediately notify their bank if their phone or laptop or any operating system through which they use the Positron Pay account is lost or stolen, so that the account introduced in Positron Pay is blocked. They can also notify Positron Pay support to deactivate the user account. It should be noted that in any case, Positron Pay is not responsible for abuse and withdrawal from user accounts.
9. It is obvious that Positron Pay commits itself to use all its efforts and capacity to maintain the security of the website; However, it is recommended that the user change their password monthly on a periodic basis. Also, the user should not store their password on their mobile phone or share it with others under any circumstances. In general, the user must keep all their information confidential; In case of user negligence in this regard, Positron Pay will not be responsible.
   • The user must delete their stored information on the Positron Pay website from the device before handing over their mobile phone, laptop or any operating system through which they use the Positron Pay account. This will delete all registered account information and received messages on that device.
   • In cases where Positron Pay is unable to provide services due to reasons such as infrastructure problems (outside the company's control, including but not limited to disruption in telecommunications, internet networks, etc.), Positron Pay will not be responsible and the user cannot claim damages under any circumstances.
   • Positron Pay will not be responsible for any possible damages to the user or problems outside its jurisdiction, such as interruption of communication lines, internet network, web services and other cases.
   • The user can receive a maximum of thirty million rials per month through Positron Pay to their account, and the maximum number of depositors cannot be more than thirty people. If the user wishes to increase the amount limit and the number of depositors, they must provide the necessary documents and sign the relevant contract to receive a merchant code. In case of violation, Positron Pay can block the user's access. In any case, Positron Pay will not be responsible for the user's violation of this clause and the possible consequences of discontinuing the user's service.
   • Positron Pay can make necessary changes to the terms and regulations of Positron Pay whenever it deems appropriate. These changes will be notified to the user appropriately, and the user is obliged to observe and implement them from the time of notification.
   • To improve the quality and security of Positron Pay services, information about device hardware, installed programs, operating system and user SIM card is stored in the system.
   • User geographic location information will be stored in the system to provide better payment services in the future.
   • In case of user dissatisfaction with Positron Pay's performance, the user can cancel their membership information. It is obvious that canceling membership will delete the user's information in the mobile application, but the user's past operations remain on Positron Pay servers for security reasons and subject records, as well as to improve system performance.
   • In accordance with the legal requirements of the Central Bank in the process of bank transfers, the user's mobile number will be provided to the bank performing the transfer.
   • In case of non-compliance with the general and specific terms and conditions of using Positron Pay and unauthorized use, Positron Pay has the right to stop providing services to the subscriber. It can also report any user information or abuse of the service to official, supervisory and judicial authorities. If any claim is made against Positron Pay due to the user's negligence or fault, or any damage is caused to the company, Positron Pay can claim all such damages from the relevant user.
   • Positron Pay is committed to observing all laws, including the list of criminal content examples under Article 21 of the Computer Crimes Law and the Electronic Commerce Law, and therefore reports all suspicious cases and information related to persons suspected of abusing Positron Pay to law enforcement and judicial authorities to be prosecuted.
   • It is recommended that the user, if they observe any unauthorized operations on their account, change their password and deactivate the system as soon as possible and notify Positron Pay support.
